My plans to provide more content about biased insurance experts have taken a back seat in the last six months. I was drawn into the world of arbitral bias, initially assisting on a matter involving a combination of expert bias and party-arbitrator bias. It led me down a path of researching so-called “neutral” arbitrator bias, which is where I’ve spent the last six months. It’s a tremendous issue, perhaps of even greater social significance than biased insurance experts. It also helps explain why the courts have avoided the expert bias issues.
